FinCEN's Residential Real Estate Rule was designed to increase transparency in the U.S. residential real estate market and help combat money laundering through real estate transactions.
However, on March 19, 2026, the U.S. District Court for the Eastern District of Texas issued an order vacating the rule. FinCEN and the Department of Justice have appealed the decision. While the court's order remains in effect, reporting persons are not required to file Real Estate Reports with FinCEN and are not subject to liability for failing to do so.
Real estate professionals should continue monitoring developments, as the appeal process could impact future reporting requirements.
